Birth registration with foreign elements





Elements of the dossier include:

• An information form of Birth registration;
• An original of the Birth certificate granted by medical establishments, where a child was born or alternative documents (if a child was born outside of the medical facilities , the birth certificate is replaced by the written certification of witnesses. In the case there is no witnesses, people registering the birth must do guarantee letters of giving the real birth);
• Agreement of a child’ parents on choosing nationality in case father, mother choosing foreign nationality for their child. The agreement must have the confirmation of competent State agencies of the nation which a foreigner is a citizen that choosing nationality for his/her child is in accordance with its regulations by law (was legalized on consul and translated into Vietnamese);
• An ID card or a passport of whom to carry out birth registration;
• A household registration books (for internal citizens), a temporary residence certification (for Vietnamese citizens settling aboard);
• An authorization letter of whom to have birth registration as provided by law (in the case of having authorization);

In the case children were born abroad , not having had birth registration. When having birth registration, a person registering the birth must guarantee that children have not had birth registration abroad, concurrently be responsible for presenting their passport (if possible); in the case of attaching children’s residence certification and passports (if possible); in the case children do not have the birth certificate or other documents to prove the birth, a person registering the birth must do a guarantee paper of the birth.

In the case children were born in Vietnam whose father or mother is a Vietnamese citizen, and the other is a foreigner; if parents choose Vietnamese nationality for their children, there must be a written agreement of the father and the mother as provided by Vietnamese Citizenship Law.
